William Gowdy KC provided evidence to the @niassembly Economy Committee on the Insolvency Bill

on behalf of the Bar of Northern Ireland earlier today.

In their scrutiny role, the Committee members were encouraged to consider that insolvency legislation should serve to assist individuals who find themselves in financial difficulties, balanced by public interest considerations and the need to ensure fair distribution amongst creditors.

There is an opportunity for the Insolvency Bill to reflect learning from England and Wales, with insolvency legislation in that jurisdiction generally accepted to be operating well.

However, the Bar also stated that the particular circumstances of this jurisdiction should be considered, where the public interest may be different.
