Romania: Press release regarding the support for the CSM’s initiative to convene general meetings of prosecutors

Recently, the public space has been marked by heated debates regarding the change of legislation concerning the status of magistrates. In the face of such a topic, with direct effects on justice but, implicitly, also on the perception of every citizen, there is a greater need than ever for a real dialogue between state institutions, for moderation in approach, and for a balanced and objective analysis that leads to the identification of optimal solutions and not just to the artificial creation of social tensions.

The rule of law fundamentally relies on the balance of powers. If this balance is affected, the entire democratic structure becomes fragile and even illusory. Therefore, any modification of the status of magistrates must be considered responsibly, with respect for the Constitution, and with a genuine consultation of those who understand the functioning and needs of the judiciary from within.

We cannot ignore the fact that Romania is going through a difficult political, economic, and geo-strategic situation. In such a context, however, the destabilization of the judiciary would be a dangerous step, with long-term consequences: overwhelmed courts and prosecutors, longer trials, dissatisfied citizens, and ultimately, a decrease in trust in the law and the gradual establishment of a climate of social insecurity.

Reform is necessary, but it must be balanced and predictable. Solutions need to be built gradually, through loyal cooperation between the branches of government and through authentic debate with legal professionals. Only in this way can we ensure that the changes do not deepen existing problems, but rather bring added stability and efficiency to justice.
