A justice system in need of an overhaul.
Suggested radical reforms to overhaul the justice system will not come to fruition without the investment and resources needed for a system on the brink of collapse. It is a lack of investment that has added to the state of justice in this country, a failure to recognise and invest in one of the necessary pillars of a democratic society. We are where we are today because of decades of underfunding of our justice system, which has resulted in a chronic shortage of judges and lawyers, huge backlogs, crumbling courts and prison spaces running out.
The Gauke review proposes the biggest shake up in sentencing laws in 30 years, but the right balance must be struck between delivering justice and reducing crime and reoffending.
Furthermore, investment is not just needed for the probation service, but also to stem the exodus of solicitors and barristers leaving criminal practice, driven by a reduction in legal aid fees, increasing levels of stress and poor working conditions.
Drastic changes are required to fix the crumbling criminal justice system. While the reforms suggested in this review offer a potential solution, they will only succeed if accompanied by adequate funding across all facets of the system, along with timely, expert advice and support.
