The Dean of the #BucharestBar Av. #AurelCiobanu is looking for solutions together with colleagues in the country regarding clerks’ strikes and magistrates’ protests

The protests of magistrates in Romania have hit hard the activity and access to justice of citizens, as evidenced by a press release of the Cluj Bar Association.
Only urgent cases are judged and in some courts activity returns to normal, in others protest is maintained.

The Bucharest Bar Association with over 10,000 members, through its Dean, Av. Aurel Ciobanu, initiated consultations on issues that already pose great problems in the activity of lawyers and legal professions at country level.

When Romanian lawyers protested for a day, this was not taken into account and the cases were tried in absentia, they were postponed where possible. There are voices who believe that each of the legal professions should support the others, but it seems that each profession has its own limits and advantages. From the political side, the reaction is clear: the independence of justice is ensured and the CSM, the ICCJ are the ones who have to solve the problems cited above.

Iasi Court upholds judges’ protest

The General Assembly of the Judges of the Iasi Tribunal, convened on January 11, 2024, at the convocation of the President of the Iasi Tribunal, having on its agenda the discussion on the continuation, suspension or termination of the form of protest adopted by Decision no. 7 of December 14, 2023 of the General Assembly of Judges of the Iasi Tribunal, decided, unanimously, until the allocation of the funds necessary for the full payment of salary rights and other outstanding salary rights:

– maintaining the form of protest;

– continuing the institutional steps in order to allocate the necessary funds for the full payment of salary rights and other outstanding salary rights;

– as of 12.01.2024, postponement of cases, including postponement of the procedure of verification and regularization of applications, except for the types of cases listed here.
